Infant Murder Case May Be Delayed

The capital murder trial against Billy Polasek that was set to start on Oct. 12 could be postponed.

Polasek, 38 of La Grange, was indicted last year for capital murder stemming from the July 4, 2016 death of seven-monthold Logan Atkins of La Grange. He was previously indicted for felony injury to a child in relation to Atkins’ death. He was reindicted for the child injury charge last year as well. Law enforcement and prosecutors have never said exactly what happened. Both indictments accuse Polasek of striking Atkins in the head with an unknown object.

Brenda Cantu, lead prosecutor with the Texas Attorney General Cyber Crime and Child Protection Unit, will represent the State. La Grange defense attorney Candice Clay represents Polasek.

The trial was set to start on Oct. 12. The defense filed a motion for a continuance last week, saying they needed more time to review new evidence presented by the State. District Judge Jeff Steinhauser has not ruled on that motion as of last Friday.
