Surprised by Hospital’s Actions

To The Editor:

I read on Tuesday, Nov. 16, 2021 in the Fayette County Record that St Mark’s Hospital is mandating employees be vaccinated to comply with a federal mandate.

I read a Fox news headline on Nov. 12, 2021 “The Fifth Circuit Court of Appeals granted a temporary stay on enforcement of the federal mandate on Nov. 6, one day after the rule was announced.” “Citing Texas’s “compelling argument[s],” the 5th Circuit has delayed OSHA’s unconstitutional and illegal private-business vaccine mandate.”

Twenty-seven states, multiple businesses, and religious groups have made legal challenges arguing the mandate is unconstitutional.

If there is a stay on the enforcement of the federal mandate, why has St. Mark’s declared a Dec. 3 deadline for employees to be vaccinated? Is the Medicare Administration threatening them?

The Medicare Administration must have to abide by the court’s ruling as well as the hospital, so the hospital should continue to receive reimbursements until the stay of enforcement is lifted. I doubt very much that the legal arguments will be settled in the next two weeks.

It surprises me that St. Mark’s does not seem to be keeping up with the science of the virus immunity or the legal aspects of the unconstitutionality of such a mandate.
