Biden Not Yet President
To the Editor:
Mr. DeLuca, spare me the hypocrisy.
I respectfully remind Mr. DeLuca Mr. Biden has not yet earned the title, President Elect, irrespective of a speech Biden gave on Nov. 7, 2020, declaring the campaign over. Mr. Biden has already broken his promise not to declare victory until the election is independently certified. Is Mr. DeLuca aware Mr. Biden is currently the subject of an active federal investigation regarding his role in the Barack Obama administration’s counterintelligence probe of the Trump campaign— “possible foreign influence-peddling and embezzlement”?
I respectfully remind Mr. DeLuca the 2nd Circuit Court of Appeals has ruled in President Trump’s favor regarding the Emoluments Clause; “The members of Congress lacked standing to pursue their claim.” Judge Pierre Leval wrote that “putting aside whether courts have jurisdiction to hear a suit seeking an injunction or declaratory relief against the President on the grounds that his official acts on behalf of the United States violate the Constitution, the proposition has no application to this case, which questions the lawfulness of the President’s purely private conduct of selling hotel and restaurant services.”
Mr. DeLuca’s accusation that President Trump “solicited election interference from foreign adversaries” was investigated for two years by Special counsel Robert Mueller and concluded in March 2019. “The discredited political opposition research document failed to support that claim...did not establish that members of the Trump campaign conspired or coordinated with the Russian government in its election interference activities”.
I respectfully remind Mr. DeLuca that it has been his party affiliates who have initiated the “harsh rhetoric”, and violent behavior seen in Texas cities and across the nation. Two months prior to Election Day, the pandemic-inspired election changes prompted the filing of at least 228 lawsuits, according to Levitt, a law professor a Loyola Marymount who specializes in election law. He reported litigation in 43 states, D.C. and Puerto Rico. Mr. DeLuca’s invitation to “join” Mr. Biden’s suggestion to “come together” requires an accurate assessment and legal resolution of these lawsuits and probable election fraud, Currently, hundreds of sworn affidavits of election workers and eyewitness accounts of ballot manipulations and personal malfeasance of election officials are being collected. Thankfully, Fayette County Texas has Terri Hefner, an honest Election Administrator with a superb staff that I commend highly, trust, and enjoy working with.
To quote The Morning Bell, Nov. 10, 2020, “there’s nothing official about the media “calling” a race. According to Article II of the US. Constitution, the next president is elected by a vote of the Electoral College on a day Congress chooses (Dec. 14). State legislatures appoint the electors based on the final vote tallies. Most states have yet to certify their official election results”
America cannot unite and heal when our Constitutional Republic is in endangered by lawlessness. Integrity in our voting process is essential.
